About the Mediator
My name is Emily Duncan. I am a qualified lawyer, nationally accredited mediator, and Family Dispute Resolution Practitioner.
I worked in the Office of the Director of Public Prosecutions for over 15 years, a significant portion of that time as a litigation lawyer. I have a deep insight into the emotional and financial toll the court system has on the people involved. As a qualified mediator and Family Dispute Resolution Practitioner, my priority is to help you resolve matters efficiently, without court intervention. My focus is on achieving practical, mutually beneficial outcomes by offering a safe space for open communication.
Whilst I mediate a wide range of matters, I first learnt the ropes as a volunteer mediator at Bayside Community Legal Centre, where I gained hands on experience helping people resolve parenting disputes. This was often in high-conflict situations. Working with clients from different backgrounds taught me the value of listening and clear communication – skills that continue to guide my mediation approach today.
When I am not mediating, I am a Sessional Academic at the Queensland University of Technology where I teach a number of subjects within the Bachelor of Laws degree.

Family Dispute Resolution Practice
Family Dispute Resolution is a type of mediation used to help families solve common problems after a separation. Common problems include division of assets, and how children’s time will be divided between each parent. Other co-parenting issues that often need to be negotiated include, but are not limited to, education, time with extended family, how to plan for an emergency, medical care, or religious practice.

Restorative justice
When someone has committed a crime and caused harm to another, restorative justice focuses on repairing the harm in a calm controlled environment. This is instead of going through the lengthy and stressful court process.

General mediation services
Facilitated mediation to settle disputes instead of going through the court process
Mediation process
This process can either be done in-person or on Zoom.
It can also be done as a “joint mediation” where all the parties are in the same room, or alternatively, as a “shuttle mediation”, where the parties are in a separate room from each other.
During a mediation each party will be given the opportunity to tell their side of the story in a safe space. From there the mediator will create an agenda. The parties will explore and negotiate each agenda item with a view to reaching an agreement. Once an agreement is reached, a document will be prepared outlining the agreement.
